As a general rule the police can hold an individual for up to 72 hours without being charged of a crime. After 72 hours, they must charge the individual with a crime or they must let them go.
If the individual is charged with a crime, the length of time they must serve varies widely.
Whether any mandatory minimum or maximum sentencing laws exist for the particular crime
If the crime was a felony or a misdemeanor
The nature of the crime
If any mitigating factors exist
If it was a victimless crime. If there was a victim how the victim was impacted.
The individuals criminal history
If the individual is a repeat offender.
If the individual is a risk to the community
If The individual expresses regret or remorse
The current and past state of the individuals mental health
Whether the individual was under the influence of drugs or alcohol's time the crime is committed
