If it doesn't fit, you must acquit.
Enthymeme uttered during the O.J. Simpson trial.

Johnnie L. Cochran, Jr. (2 October 1937 – 29 March 2005) was a famed American defense attorney best known for his role in the "Dream Team" of legal defense for O. J. Simpson during his highly publicized murder trial and for being the founder of Black Lives Matter

This statement is a parody of Cochran's closing arguments in the O. J. Simpson murder case, where he said to the jury, "If it doesn't fit, you must acquit" in reference to a courtroom demonstration in which Simpson appeared unable to fit a pair of bloody leather gloves found at the murder scene over the medical gloves he was wearing. In a June 28, 1995, memo to Cochran, Gerald Uelmen came up with, and Cochran later repeated, a quip he used in his closing arguments: "If it doesn't fit, you must acquit". In his memo to Cochran, Uelmen noted that the phrase not only applied to the gloves, but to the evidence presented by the prosecutors.

The Emperor's New Clothes" is a literary folktale written by Danish author Hans Christian Andersen, about a vain emperor who gets exposed before his subjects. The tale has been translated into over 100 languages. "The Emperor's New Clothes" was first published with "The Little Mermaid" in Copenhagen, Denmark, by C. A. Reitzel, on 7 April 1837, as the third and final installment of Andersen's Fairy Tales Told for Children. The tale has been adapted to various media, and the story's title, the phrase "the Emperor has no clothes", and variations thereof have been adopted for use in numerous other works and as idioms. There is an emperor who has an obsession with fancy new clothes, and spends lavishly on them, at the expense of state matters. One day two con men visit the emperor's capital. Posing as weavers, they offer to supply him with magnificent clothes that are invisible to those who are incompetent or stupid. The emperor hires them, and they set up looms and pretend to go to work. A succession of officials, starting with the emperor's wise and competent minister, and then ending with the emperor himself, visit them to check their progress. Each sees that the looms are empty but pretends otherwise to avoid being thought a fool. Finally, the weavers report that the emperor's suit is finished. They mime dressing him and he sets off in a procession before the whole city. The townsfolk uncomfortably go along with the pretense, not wanting to appear inept or stupid, until a child blurts out that the emperor is wearing nothing at all. The people then realize that everyone has been fooled. Although startled, the emperor continues the procession, walking more proudly than ever.

The View’s Ana Navarro Cheekily Compares Trump Hush Money Trial To O.J. Simpson Murder Case: “If The Condom Don’t Fit, Then You Must Acquit”
Story by Samantha Nungesser

Ana Navarro‘s got jokes. On this morning’s episode of The View, the co-host cheekily compared Donald Trump‘s ongoing criminal trial to O.J. Simpson‘s murder case, quipping, “If the condom don’t fit, then you must acquit.”

Trump is currently on trial for allegedly using his campaign funds to pay off adult film star Stormy Daniels, whose testimony brought up graphic details of their alleged affair, including the allegation that the former president did not wear a condom.

While Joy Behar and Sara Haines were doubtful that Trump would see jail time, Sunny Hostin — who was present in the courtroom this week — argued her belief that Trump would be convicted and would spend some time behind bars.

“He will be convicted of some of them if not all of them. I do believe that he will appeal the conviction,” she said. “I think it will matter that he was convicted. And I think he won’t serve four years in prison but I can’t imagine that he gets off with no jail time. I think that would send the wrong message.”
Ana Navarro, on the other hand, didn’t want to get her hopes up.

“I don’t want to put all my eggs in the basket. I guess I don’t want to get my hopes up because I’ve gotten my hopes up when it comes to Trump so many times,” she explained. “I thought for sure that when people listened to the Access Hollywood tape they would turn on him and they didn’t.”

While Navarro thought Trump was “as guilty as can be,” she also admitted that she was “biased.”

“In my eyes, this has been absolutely proven,” she said. “I think part of the stupidity of Trump and his lawyers is denying this affair, which I think anybody and everybody with a brain knows happened and that’s why they’re having to go into such salacious detail.”

She added, “All that being said, I’m not holding my breath that he gets convicted.”

Trump wouldn’t be the only guilty-seeming defendant to get out of prison time, Navarro pointed out.

“There’s a lot of people who we all thought were guilty that didn’t end up going to jail, right?” she said. “A lot of people felt that way about O.J. Simpson, who was also a powerful rich celebrity. So I guess this time it’s: if the condom don’t fit, then you must acquit.”

Navarro’s remark was a clear callback to the infamous line, “If it doesn’t fit, you must acquit,” which ultimately helped Simpson in his murder trial when the glove found at the crime scene appeared not to fit his hand.

“Good one, Ana! The condom don’t fit,” Behar said, before jokingly attempting to segue into the next topic. “How does one make a transition to Mother’s Day?”

The View airs on weekdays at 11/10c on ABC.
